
Food & Agriculture Practice
Food products are regulated to safeguard public health and ensure that food is safe, sanitary, nutritious, and accurately labeled. In the U.S., food safety regulations are established and enforced by the U.S. Department of Agriculture (USDA) and the U.S. Food and Drug Administration (FDA). Although these agencies share the regulatory landscape, they operate within distinct jurisdictional scopes to ensure comprehensive regulatory enforcement for all products marketed in U.S. interstate commerce.
Additionally, all food and agricultural products must be declared and are subject to inspection by the U.S. Customs and Border Protection (CBP). At each port of entry, the CBP ensures that imports are properly taxed and works with other agencies to ensure that products are free from plant pests and foreign animal diseases. Prohibited or restricted items may include meats, fresh fruits and vegetables, plants, seeds, soil, and products made from animal or plant materials.
