An agreement is a manifestation of mutual assent between two or more parties. It represents a meeting of the minds with a common intention, typically formed through offer and acceptance. An agreement can be evidenced through words, conduct, or, in some cases, even silence.
A contract, on the other hand, is a legally binding agreement that establishes promises and obligations between two or more parties. Contracts can be express or implied and may be written or verbal. While the terms "agreement" and "contract" are often used interchangeably, most business activities today adhere to the contract doctrine due to its formal nature and enforceability.
